Terms of service

These Terms govern your use of hawaiian.jewelry, shop.hawaiian.jewelry and japan.hawaiian.jewelry (the “Site”) and any purchase from [LEGAL ENTITY], doing business as hawaiian.jewelry (“we”, “us”). By using the Site or placing an order, you agree to these Terms and to our Shipping, Custom orders, Returns, and Privacy policies, which are part of these Terms.

1. Products

All items are made to order according to the options you select. Images are representative. Natural materials vary. We may discontinue products or options at any time.

2. Pricing and currency

Prices on shop.hawaiian.jewelry are in US dollars; prices on japan.hawaiian.jewelry are in Japanese yen. The price for your configuration is calculated and displayed before you check out. We may correct pricing errors; if an error affects an order you have placed, we will contact you and offer to proceed at the correct price or cancel for a full refund.

3. Taxes

Orders shipped to a Hawaiʻi address include Hawaiʻi General Excise Tax at the rate applicable to the delivery county, shown at checkout. Orders shipped outside Hawaiʻi are not charged Hawaiʻi GET. Orders to Japan include import duties and consumption tax, calculated and shown at checkout.

4. Orders and payment

Your order is an offer to purchase; it is accepted when we send the order confirmation. Payment is processed by Stripe; we do not store full card numbers. We may decline or cancel an order for suspected fraud, pricing error, or inability to ship to your address, in which case any payment is refunded.

5. Custom specifications and proof approval

You are responsible for the accuracy of options, sizes, and engraving text you enter and approve. We send a proof before production; approval (or the automatic proceed date stated in the proof emails) confirms the specification. See the Custom orders policy.

6. Reviews

If you leave a product review, you grant us a non-exclusive licence to display it (with the display name and any photos you provide) on our sites and in product listings on Google. Reviews must be your own honest opinion; we only accept reviews from verified purchasers, we do not offer incentives for reviews, and we may decline to publish reviews that are off-topic, abusive, or contain personal information.

9. Intellectual property

All designs, images, text, and the hawaiian.jewelry name are our property or used with permission. You may not copy or reproduce designs for commercial purposes. By submitting engraving text, you confirm you have the right to use it and that it does not infringe anyone’s rights or contain unlawful content; we may refuse engraving requests at our discretion and will refund any affected order.

10. Warranty disclaimer

Except for the express workmanship warranty in our Returns policy, products are provided “as is” to the fullest extent permitted by law, and we disclaim implied warranties including merchantability and fitness for a particular purpose. Some jurisdictions do not allow such limitations; in that case they apply only to the extent permitted.

11. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages.

12. Governing law

These Terms are governed by the laws of the State of Hawaiʻi, USA, without regard to conflict of law rules. Where the law of your country of residence gives you non-waivable consumer rights, those rights are unaffected.

13. Changes

We may update these Terms; the version in effect when you order applies to that order.
